Volusia County, FLorida Traffic Infraction Attorneys

Should I fight my traffic ticket?

Absolutely. You could just pay the ticket, but that would be the most expensive option. Paying the ticket is an admission of guilt and results in a conviction. With a ticket on your driving record, your insurance rates will go up. High insurance rates really add up over the years. And with each additional ticket, penalties get more severe.

What can an attorney do about a traffic ticket?

An attorney can attend a hearing for you, where the law enforcement officer must prove the alleged infraction beyond a reasonable doubt.  An attorney can protect a driver's license by requesting that no points be assessed (adjudication withheld) by the court.

In addition, an attorney may be able to persuade the Court to allow you to take a driving school option even though you are ineligible by statute either due to a recent driving school election or because the maximum school allowance has been surpassed.  NOTE: This option does not guarantee that no points will be assessed or that you won't required to attend a driving school.  After a hearing, a court can require a driver to pay a fine up to $500 ($1,000 in some accident cases), attend a driving school, assess points, and suspend your license.

People go to jail every day in Volusia County simply for driving without a license

Getting a ticket for Driving with License Suspended can lead to a lot of trouble, expense, and even jail. If the prosecution can prove that you knowingly drove with a suspended or revoked license, you could spend up to a year in jail. If you are convicted three times in a five year period for Driving with License Suspended, you will be labeled a Habitual Traffic Offender. That means your license will be suspended for 5 years. Imagine the consequences that being unable to drive would have on your life.

Fight to win with Traffic Defense Attorney Eric A. Morgan

The smartest choice is to fight the ticket, with an attorney’s help. An attorney can attend the hearing for you, where the police officer must prove the alleged infraction beyond a reasonable doubt. An attorney can protect your driver’s license by requesting that no points be assessed by the court. It may be possible to plea to a lesser charge, or the evidence may be suppressed due to a mistake by the police. That’s why it’s so important to fight every ticket.
